The ins and outs of favouring Bermudians

I recently posted about some of the proposed changes to Bermuda's work permit policies. One thing that arises is the suggestion of a hiring hierarchy - favouring Bermudians first, then spouses, then divorced parents of Bermudians, then PRC holders, then other non-Bermudians with a 'qualifying connection' (see 1.6). There is also a 'reminder' of a laying off hierarchy of non-Bermudians ahead of Bermudians (which doesn't exist in the Employment Act). Is there a legal basis to try and establish such a hierarchy?
